Invitation for Bids

1. The Democratic Socialist Republic of Sri Lanka has received a loan from the Asian Development Bank (ADB) towards the cost of road rehabilitation and upgrading of about 220 km of national highways under the National Highways Sector (NHSP). Part of this loan will be used for payments under the contract named above.
2. The Road Development Authority (the Employer) now invites sealed bids for the Rehabilitation and Upgrading of Puttalam - Trincomalee Road (A012) from Puttalam (3.0km) to Nochchiyagama (53.0KM) covering North Western Province and North Central Province, from eligible bidders, who must meet the following criteria on a pass/fail basis:
A. Financial:
- The Bidder shall have (i) a minimum average annual construction turn over of US$ 17 million within the last 3 years; and (ii) as a minimum, the Bidder's net worth should be positive;
- The Bidder must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet (a) a cash-flow requirement, US$ 4 million; and (b) the overall cash flow requirements for the ICB 01 contract and its current works commitment.
B. Experience:
- The Bidder must have general experience in construction contracts for at least 5 years;
- The Bidder must have specific construction experience by participating as contractor, management contractor, or subcontractor, in at least 1 contract within the last 6 years, with duration of 2 to 3 years, with a value of at least US$ 18 million that have been successfully or are substantially completed and that are similar to the proposed works.
- The Bidder must have construction experience in the following key activities: (i) Earth Work (180,000 cubic meters per year); (ii) Portland Cement Concrete Pavement (PCCP) (4,000 cubic meters per year); (iii) Aggregate Base Course (50,000 cubic meters per year); and (iv) Asphalt Concrete-Hotmix (40,000 cubic meters per year.
C. Personnel:
- The Bidder must demonstrate that he has the personnel for the following key positions for this project: (i) Project Manager (Professionally Qualified Civil Engineer with minimum 6 years experience in similar work); (ii) Highway or Bridge Engineer (Professionally Qualified Civil Engineer with minimum 6 years experience in similar work); and (iii) Materials and Quality Control Engineer (Qualified Civil Engineer or equivalent with minimum 6 years experience in similar work.)
D. Equipment:
- The Bidder must demonstrate ownership and availability the key equipment listed below and must submit with its proposal a Certificate of Ownership (e.g. the Official Registration Certificate) for each of the following:

E. Litigation:
- The Bidder shall provide accurate information on any litigation or arbitration resulting from contracts completed or under execution by it over the last 6 years. Claims, arbitration or other litigation proceedings pending, with a possible impact of more than 50% of the Bidder's net worth shall be grounds for declaring the Bidder not qualified for the award of the contract.
F. Any person who acts as an agent or sub-agent, representative or nominee for or on behalf of any bidders shall submit along with the bid, a certified copy of registration under Section 8 of the Public Contract Act No 3 of 1987 of the Democratic Socialist Republic of Sri Lanka.
3. The rehabilitation and upgrading activities (the Works) include:
- Site Clearing and Excavation;
- Road formation improvement;
- Sub Base construction, Dense graded aggregate base with surfacing of AC overlay;
- Concreting;
- Drainage construction/ improvements;
- Bridge/Culvert rehabilitation and construction;
- Relocation of utilities; and
- Facilities for the Engineer.
The Work will be carried out within the existing right of way unless otherwise specified. The section from 3+000 (Puttalam) to 53+000 (Nochchiyagama) will be a single carriageway of 2 lanes each 3.1m in width, 0.9m wide hard shoulders, 2.0m wide earthen shoulder and 1.0m wide drains on either side.
4. International Competitive Bidding will be conducted in accordance with ADB's Single-Stage: One-Envelope Bidding Procedure with post qualification and is open to bidders from eligible source countries of ADB.

6. To purchase the Bidding Document in English, eligible bidders should:
- Write to address above requesting for the Bidding Documents for Rehabilitation and Upgrading of Puttalam - Trincomalee Road (A012) from Puttalam to Nochchiyagama(RDA/NHSP/ICB 01); and
- Pay a non-refundable fee of SLR 15,000 or US $150 by cash or direct deposit to the account of Cabinet Appointed Procurement Committee, Ministry of Highways & Road Development.
7. Bid must be delivered:
- to the address below;
- on or before 17 November 2008 at 2:00 pm. Late bids will not be accepted.
- together with a Bid Security of SLR 35 million.
8. Bids will be opened on 17 November 2008 at 2:15 pm at the address below in the presence of bidders' representatives who choose to attend.
