D. Governance Dimensions of ADB Operations83. Since the mid 1990s, governance has become an increasingly important part of ADB’s PRC operations. ADB’s work in governance will continue during the program period, particularly work related to law and development. ADB is currently supporting the drafting of several important economic laws and regulations (e.g., bankruptcy, company, social security, trust, closing involvement financial institutions, registering commercial and industrial organizations, administrative licensing). New law and development TAs added to the program include reviewing banking laws and regulations and examining the implications of WTO membership on law reform. In 2003 ADB will begin to examine the development of a legal assistance system which will strengthen the linkage between ADB’s law and development work and poverty. 84. ADB missions have been raising issues of governance, including corruption, with the Government during the course of country operations and all phases of the project cycle (e.g., country programming mission, country program review mission, project appraisal, review, and post-evaluation). Assistance was provided to improve governance and reduce the potential for corruption in the longer term by introducing transparent, competitive bidding. The progress made under TA 2845-PRC (Establishment of National Procurement Regulations for the Public Sector) is being followed up by support for drafting the implementation regulations for the 1999 Tendering and Bidding Law and assistance for the preparation of Government Procurement Law under. Additional TA is included in the program to extend the work under TA 3138-PRC (Regulatory Framework for the Engagement of Consultants), to help develop a consulting industry in which consultants are engaged in a transparent, competitive manner. Other areas of governance covered by the program include continuing ADB’s work in supporting fiscal reform, strengthening the accounting profession and evaluating methods and standards for efficient corporate management.
