National Treatment

Unlike the GATT, the National Treatment obligation of of the GATS (Article XVII) is not one of general application, but depends on the commitments inscribed in Members' Schedules.

For the sectors inscribed in its Schedules (and subject to any conditions and qualifications set out therein), each Member must "accord to services and service suppliers of any other Member, in respect of all measures affecting the supply of services, treatment no less favourable than that it accords to its own like services and service suppliers." In other words, the NT obligation applies to any sector or sub-sector listed in the first column of the Schedule, except in so far as "conditions and qualifications" are listed in the third.
