Feature: ADB Introduces Whistleblower and Witness Protection Provisions

On 11 December 2009, ADB issued provisions for whistleblower and witness protection in order to provide a comprehensive and coordinated approach to protect whistleblowers and witnesses acting in good faith. It was also intended to ensure that they are not subject to retaliation.

Enhancing Development Effectiveness

Differentiation of email addresses between staff and consultants/contractors

Before December 2009, all emails from ADB staff and consultants or contractors employed by ADB had the same domain name, i.e. xxx@adb.org.

However, OAI found in a variety of investigations that ADB’s email address is a commodity that is used by non-ADB staff to enhance such person’s personal interest.

ADB’s name and email address has been used by non-staff to misrepresent goods and services as being from ADB, including for solicitation of business opportunities, social relationships and marriage proposals, and for obtaining financial and pecuniary advantages.

Based on lessons learned from those investigations, ADB, among other strengthening of its operations, decided to change all external addresses of consultants and contractors to differentiate them with staff email addresses. Effective 1 December 2009, ADB consultants’ email became xyz.consultant@adb.org and contractors’ email became xyz.contractor@adb.org.

Extension of Sanctions to PT Juwita Samudera Kencana (Indonesia)

PT Juwita Samudera Kencana violated an ADB sanction. As a firm, its sanction has been extended to 10 years from 14 December 2009 to 14 December 2019. No contracts or contract variations should be issued for this company. Its President Director, H. Suparmin has been declared ineligible indefinitely.
