Legal AgreementsADB enters into a legal agreement(s) with an ADB member, its related institution or a regional institution for each public sector project, to specify the amount and source of the funding, repayment terms, and the project implementation arrangements. If funding is by way of a loan, the terms and conditions of the loan will be specified in a Loan Agreement. If grant funding is involved for the project, then conditions of the grant will be specified in a Grant Agreement or in a Financing Agreement where the funding is partly loan and the remainder by grant. There are sometimes additional project related agreements. For example, where a third party which is not directly part of the ADB member counterpart is implementing a project, or part of a project, then a Project Agreement will also be entered into with that third party, regarding its obligations under the Project. In accordance with ADB's public communications policy, legal agreements relating to investments by ADB in the private sector are not disclosed because their terms and conditions are treated as confidential information or are otherwise covered by the disclosure exceptions referred to in paragraph 126 of the PCP. |
