Technical Assistance to the Socialist Republic of Vietnam for Enhancing the Resettlement Legal Framework and Institutional Capacity -- TA No. 3727-VIE

  • ADB Approval of Grant to Socialist Republic of Vietnam, September 2001

    The Viet Nam Ministry of Finance will utilize the Grant to continue the work on developing a National Resettlement Action Plan (NRAP) and preparing a new decree on compensation and rehabilitation to replace Decree 22/CP.

    Goal

    The new decree is intended to set good national standards for land acquisition and resettlement. While recognizing the specific features of Viet Nam's legal and social systems as prescribed in the 1995 Civil Law, 1993 Land Law and Decree 52/CP, the new decree will also reflect good international practice and lessons learned from past projects.

    Activities

    • Complementary implementing guidelines for the new decree will be formulated.
    • Once the decree is approved, a training needs assessment will be conducted to target sectors, provinces, districts and line agency personnel involved in resettlement planning and implementation.
    • Information dissemination and multi-sectoral consultations will be conducted.

  • Commencement of Project Implementation, November 2001

    The Viet Nam Ministry of Finance will implement the Technical Assistance in 18 months, commencing on November 2001.
