MANILA, PHILIPPINES — High court judges from the Association of Southeast Asian Nations (ASEAN) reaffirmed their commitment to environmental law and climate change at a roundtable meeting last weekend in Cambodia.

The Fifth ASEAN Chief Justices’ Roundtable on Environment was organized by the Asian Development Bank (ADB) and hosted by the Supreme Court of Cambodia in Siem Reap on 4-5 December, 2015.  High court judges from all 10 ASEAN countries and ADB’s General Counsel, Christopher Stephens, discussed the challenges faced by ASEAN countries when applying laws on the environment and climate change, and determining complex issues of environmental impact, damage assessment, and valuation and adjudication. 

The Chief Justices’ Roundtable, which ADB has been sponsoring since 2011, is unique to the Asia Pacific region. Together with the Chief Justices’ Roundtable for the South Asia Association of Regional Cooperation (SAARC), which ADB also started in 2012, Asia is the only region in the world that convenes Chief Justices’ roundtables dedicated to environmental issues, and ADB is the only regional multilateral development bank supporting such meetings. 
    
Among the key issues discussed at the ASEAN roundtable were balancing the realities of economic development in the region and the need for environmental protection. Participants recognized the need for capacity building in areas such as environmental damage assessment; statutory penalties; the technical and financial issues of cleanup; restoration and remediation; and public interest environmental litigation. 
  
The roundtable also highlighted the significant progress made in creating national or regional working groups on environment, “greening benches”, and building capacity for environmental adjudication, including judicial training and certification programs on the environment.

“Each of the ASEAN countries has signed relevant treaties on environmental protection and have most of the necessary national laws and regulations required to protect the environment but gaps still remain in the application and enforcement of those laws, and much of that gap arises from lack of capacity and resources among judiciaries,” said Mr. Stephens.  “The ASEAN judiciaries hold a powerful leadership role in steering domestic and regional action towards environmentally sustainable development.” 

ASEAN member countries are Brunei Darussalam, Cambodia, Indonesia, Lao People’s Democratic Republic, Malaysia, Myanmar, Philippines, Singapore, Thailand, and Viet Nam.

Similar roundtables have also been held in South Asia in the past few years. A few days before the ASEAN Chief Justices’ Roundtable, ADB and the Supreme Court of Nepal co-organized the Fourth South Asia Judicial Roundtable on Environmental Justice in Kathmandu on 28-29 November. The event brought together Chief Justices and senior judges, legal professionals, and multi-disciplinary experts from South Asian countries, Brazil, the UK, and the US. At the end of the roundtable, the participants reaffirmed their continuing commitment to promote environmental protection and climate change mitigation and adaptation through more effective jurisprudence in South Asia.

New Book Showcases Cutting Edge Reforms in Clean Up of Chao Lake

BEIJING, PEOPLE’S REPUBLIC OF CHINA – An Asian Development Bank (ADB) project to clean up one of the great lakes of the People’s Republic of China (PRC) is on course to succeed where many similar projects have not been successful thanks to cutting edge reforms, according to a new book launched today. 

The second volume on “Reviving Lakes and Wetlands” focuses on Chao Lake in Anhui Province where in 2011 the PRC requested ADB to design an integrated water pollution control project.

The lake has suffered long-standing pollution problems, including most recently from the runoff from fertilizer residues and waste emissions from livestock production. These have been causing unattractive and foul smelling algae and a reduction in fish stocks. During the summer of 2010, an outbreak of blue-green algae threatened the drinking water supply of the 300,000 residents of eastern Chaohu City.

ADB approved a loan of $250 million in November 2012 to clean up the lake. The project includes investments in traditional environmental infrastructure, such as sewerage networks, wastewater treatment plants, and solid waste management, but also nonstructural innovations, such as pilots to test on-farm technologies, and an incentive system for farmers to replace chemical fertilizers with organic ones. 

With ADB’s assistance, the government has taken three major steps to create a basic framework to achieve its long-term objective of improving water quality in the lake. These are the development of a coherent and comprehensive master plan, the creation of an administrative structure that places most of the upper catchment within the jurisdiction of a single administrative body, and the creation of the Chao Lake Management Authority as the institution with primary authority and responsibility for managing the lake. 

The new book documents ADB’s interventions in the lake, discussing the challenges and remedies to Chao’s long-standing pollution problems, and analyzes the initial reforms that have taken place. It compares the PRC experience with four case studies from Australia, Japan, the UK, and the US.  

“The government is aware of the generally poor and still deteriorating condition of many of the country’s aquatic ecosystems and has been devoting substantial amounts of time, money, and effort to reverse the situation,” said ADB Vice-President Stephen P. Groff at the book launch in Manila. “Hopefully the strategy to clean up Chao Lake detailed in ADB’s new book should provide a new blueprint for lake rehabilitation in the country, as well as internationally.”

The book follows a first volume that came out at the end of December 2008, covering the crucial factors for succeeding in lake and wetland restoration in the PRC. That book highlighted four elements for success: strong and consistent political leadership, integrated planning and analysis, effective management structures, and financial engineering.
  
Volume 2 stresses that while the creation of a lake authority is a step in the right direction, it needs considerable strengthening, as does the whole financing, operation, and maintenance of the lake's environmental operations.

菲律宾马尼拉 — 亚洲开发银行(亚行)今日发布的一本新书称,得益于创新的改革措施,亚行在中华人民共和国(中国)的一项治理大型湖泊的项目进展顺利,而此前许多类似的湖泊治理项目未能取得预期的治理成果。

《湖泊和湿地生态恢复》的第二卷聚焦于安徽巢湖,2011年,中国安徽省向亚行申请贷款治理巢湖流域水环境。

长期以来,巢湖一直饱受污染问题困扰,包括近期来自农药化肥径流流失和牲畜养殖的污染。污染导致巢湖藻类繁殖,恶臭四溢,鱼类资源锐减。2010年夏,蓝绿藻爆发威胁到巢湖市东部300,000居民的饮用水供应。

2012年11月,亚行批准了一项2.5亿美元的贷款用于巢湖治理。该项目既包括对传统环境基础设施(如排污系统、污水处理厂和固体废弃物管理等)的投资,也包括非结构性创新,如试点农田技术试验,以及激励农民使用有机肥料替代化学肥料。

在亚行的协助下,政府采取了三大举措以建立一个湖泊治理的基本框架,从而实现改善巢湖水质的长期目标。三大举措分别是:制定协调一致的全面总体规划;创建行政结构,将大部分巢湖上游集水区划归单一行政机构管辖;建立巢湖管理局,使其成为负责管理巢湖的综合部门。

 “中国政府意识到,许多水域生态系统的总体情况不容乐观,并且仍在进一步恶化,为扭转局面,中国政府已投入了大量的时间、金钱和精力,”亚行副行长史蒂芬•格罗夫(Stephen P. Groff)在马尼拉举行的新书发布会上表示:“希望亚行新书中阐释的巢湖治理战略能够为中国乃至国际上的湖泊生态恢复提供新的蓝图。”

该书第一卷已于2008年12月底出版,内容涵盖了中国湖泊和湿地生态恢复工作获得成功的关键因素。书中重点介绍了四大成功因素:坚定和持续一贯的政治领导力、统筹规划与分析、有效的管理结构和金融工程。 

第二卷强调,尽管建立湖泊管理局是朝正确的方向迈出了一步,但是这一措施需要得到充分强化,农村环境基础设施的融资、运营和维护也需要得到极大改善。

亚行总部设在菲律宾首都马尼拉,其工作旨在通过包容性经济增长、环境可持续发展和区域一体化帮助其发展中成员体减少贫困,改善亚太地区人民的福祉。亚行成立于1966年,现有67个成员,其中48个来自亚太地区。2014年,亚行援助总额达到229亿美元,其中包括92亿美元的联合融资。
